Notice of Copyright or other Intellectual Property Infringement

1. Our Commitment to Intellectual Property Rights

Ibtiaath Ltd ("Ibtiaath", "we", "us", "our") respects the intellectual property rights of others and expects all users of our platform, website, and mobile application to do the same. We comply with the Digital Millennium Copyright Act (DMCA), the UK Copyright, Designs and Patents Act 1988, and all applicable intellectual property laws.

2. Reporting Copyright or IP Infringement

If you believe that content available on or through our platform infringes one or more of your copyrights or other intellectual property rights, please send a written notice ("DMCA Takedown Notice") to our designated agent containing all of the following information:

  1. Identification of the copyrighted work — A description of the copyrighted work or other intellectual property that you claim has been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material — A description of the material that you claim is infringing and that you request us to remove or disable, and information sufficient to permit us to locate the material (e.g., the URL or other specific location on our platform).
  3. Your contact information — Your name, mailing address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner of the intellectual property right that is allegedly infringed.
  6. Signature — A physical or electronic signature of a person authorised to act on behalf of the owner of the copyright or other intellectual property interest.

4. Counter-Notice Procedure

If you believe that material you posted on our platform was removed or disabled as a result of a mistake or misidentification, you may submit a Counter-Notice to our designated agent. Your Counter-Notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the courts of England and Wales, and that you will accept service of process from the person who provided the original DMCA notice.

5. Repeat Infringer Policy

In accordance with the DMCA and applicable UK law, Ibtiaath has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Ibtiaath may also, at its sole discretion, limit access or terminate the accounts of any users who infringe any intellectual property rights of others.

If you believe your trade mark rights have been infringed on our platform, please contact us at legal@ibtiaath.com with the subject line "Trade Mark Notice" and provide your trade mark registration details, jurisdiction, and the specific content you believe is infringing.

7. Disclaimer

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.
